The station is CFZM in Toronto, which is Moses Znaimer's relicensing of one of the CBC's clear channel AM allocations, formerly CBL-740, which operates with 50,000 watts non-directional day and night. The FM repeater is meant to fill in the reception gaps in Downtown Toronto. The 22.4 or 82 watts don't sound like much, but should do the job atop a tower that is 280.1 metres above average terrain. That is 919 feet.
The "Dissenting Opinion of Commissioner Raj Shoan" is also interesting in his review of past applications for nested FM repeaters. Most notably, that the CRTC counts the FM repeater as an FM station for Common Ownership purposes. Which guarantees that CKNW's application will be turned down.
That would seem to open the door wide to future applications for nested FM repeaters for AM stations. But, only for companies not already owning the limit of FM stations in the market allowed by current Common Ownership rules. For example, in Edmonton, the remaining commercial AM stations are CHED-630, CFCW-790, CHQT-880, CJCA-930 and CFRN-1260. All but CJCA already have two FM stations owned by the same company.
