Broadcaster sues CTV over dismissal

Broadcaster Terry David Mulligan is suing CTV for wrongful dismissal, claiming he was fired without cause, given inadequate notice and discriminated against on the basis of his age.

Mulligan, 65, an award-winning radio and TV broadcaster who lives in Penticton, had been with CHUM Ltd. for 24 years when the company was taken over by CTV last September.

"Terry is a vigorous, enthusiastic guy, with a lot more to offer," said his Vancouver lawyer, Murray Tevlin. "He is alleging that in the takeover of CHUM by CTV, he was dismissed for no good reason."


In a statement of claim filed in B.C. Supreme Court, Mulligan says his last written contract with CHUM removed terms allowing termination of employment for any reason upon 90 days' notice or payment of 16 weeks' salary.

He says the notice provision in the contract was "unlawful" because it was in contravention of employment standards legislation.

Mulligan was fired Nov. 19, with his last day of work Dec. 31 and with six-months' severance. He calls CTV's policy on mandatory retirement discriminatory. CTV could not be reached for comment.
